Federal Court Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal custody.

In her order, the judge noted that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Background of the Case

The legal proceedings center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.

Conditions of Freedom

The court, who was hearing his petition to removal in a federal court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order shifts his supervision to the Tennessee court.

This decision marks a notable turn in a complex immigration case involving claims of wrongful detention and disputed criminal associations.
